Supreme Court:: The Supreme Court has decided to issue a case to a main lawyer, asking why the designation provided to him by the Apex Court should not be canceled. This unprecedented decision was born of allegations of misconduct against the main defender Rishi Malhotra. The whole court summoned by chief judge Sanjeev Khanna decided unanimously. It was made up of judges from all the main courts on the administrative side. The Supreme Court made strong comments against Malhotra on February 20.
Lawyers accused of having deleted many facts
The lawyer is accused of having removed significant facts in several cases of premature release of prisoners, in addition to making misleading declarations despite warnings from the Supreme Court. The entire court authorized the secretary general Bharat Parashar to issue a notice of justification. Parashar said that Malhotra should have another opportunity to clarify his conduct before depriving him of the senior designation.
In his decision of February 20, a bench of judge Abhay a Oka and judge Augustine George Christ criticized his conduct in a recent case and accused him of not having disclosed that the Supreme Court prohibited the convicted for 30 years. Likewise, the court concluded that Malhotra had misleaded the Supreme Court on other occasions.
Questions raised
The Supreme Court said: “We clarify that we will not record any final conclusion against the main defender Rishi Malhotra, on the question of whether his designation can be withdrawn, we leave the decision to decide the question to the Chief of India.” The bench said what he presented is certified by files. The court said that Malhotra had been appointed principal lawyer on August 14, 2024. The bench expressed its surprise if the higher designation system established under these decisions actually worked effectively.
The bench said that, to answer this question, a serious introspection requires that the rules established in the context of these decisions have guaranteed that only qualified defenders are being appointed. The bench said it could neither disagree with two binding decisions nor adopt the opposite approach. The bench said, however, all we do is to express serious doubts and concerns. We propose to give instructions according to which the question should be placed before the chief judge of India to determine if it is necessary to rethink the appropriate number on the issue. (PTI)
