Delhi News:: The High Court of Delhi has referred to the “excessive reduction of judges” given the number of cases in proportion to the population, because of which many cases remain unknown. The High Court said that due to the large number of pending cases, it is unable to make decisions on time and when certain cases remain unknown, it is “extremely painful” for the judge.
“Due to the high number of pending cases …”
The court made this comment while hearing a convicted person in the fraud and counterfeit case. The person had asked to allow a foreign trip to participate in the assembly of the Rotary Club club in Almaty, Kazakhstan and Georgia for their social relations and business development.
Judge Girish Kathpalia said: “I think, since the number of matters pending is high, this court is unable to decide on appeals within the appropriate time, so the right to travel should not be refused to some extent.”
“Regular cases are not heard for a long time”
The court authorized the person to travel abroad from May 1 to May 11 on a personal deposit of five lukh rupees and on deposit of the same amount. The court said that social and commercial relations are developing in programs such as the Rotary Club assembly. The court said: “Due to the huge shortage of judges and the number of cases, regular affairs are not heard for a long time,” said the court.
Judge Kathpalia said: “Several times even after five in the evening, some cases are not heard even when the courts are open, which is extremely painful for the judge. In such an uncertain environment, depriving the independent traffic petitioner, even if he only wants to enjoy the trip, this cannot be justified.”
The court mentioned that the appeal of a person contesting his conviction in the Fraud and Fogery case had been filed at the High Court in 2019 and that the previous judge accepted him, and now he will be heard as a regular case. The person’s lawyer argued that he was authorized to go abroad earlier and that there was no possibility for his escape due to the age of 67.
