WAQF modification law:: The Supreme Court refused Tuesday to examine 13 new petitions contesting the constitutional validity of the 2025 WAQF law (amendment), saying that it could not add more petitions, because it would be difficult to manage them.
What does the court say?
The lawyers of several petitioners urged the bench of the chief judge of India Sanjeev Khanna and the judge Sanjay Kumar to hear their petitions as well as the current petitions. After that, the bench said: “We will no longer increase the number of petitions … They will continue to grow and it will be difficult to manage them.”
However, the bench, notably Feroz Iqbal Khan, Imran Pratapgarhi, Sheikh Munir Ahmed and “Muslim Advocates Association”, asked the petitioners to interfere with the main petitions if they have an additional base to challenge the WAQF law.
‘We will all hear’
The chief judge said we will all get along … Five cases have been registered. If you want to argue on additional points, submit an intervention request in case.
The court, adopting a similar ordinance on Monday, refused to examine a new petition contesting the constitutional validity of the 2025 law in the WAQF (amendment) and said that he could not hear petitions “hundreds” on the issue. The bench had asked the Syed Ali Akbar petitioner council to file an intervention request in five outstanding cases on which the hearing will be held on May 5 to adopt the provisional order.
On April 17, the bench had decided to hear only five of the total petitions. In About 72 Petitions Filed Against The Law, ‘All India Majlis-E-Ittehadul Muslimeen’ (Aimim) Leader Asaduddin Owaisi, ‘All India Muslim Personal Law Board’ (Aimplb), Jamiat Ulema-E-Hind, Dravida Munnetra Kashagam (DMK), Karnataka State Board of Karnataka State Board of Karnataka State Board, Congress MP Imran and Mohammad. Javed petitions are included.
The bench appointed three lawyers as nodal lawyers and asked them to decide who will discuss. The center recently informed the law. The law was approved by President Draupadi murmu on April 5 after the law was adopted by the Parliament. The bill was supported by 128 members and 95 members of Rajya Sabha, while 288 members of Lok Sabha supported it and 232 members voted against.
